1. INTRODUCTION
1.1. These Terms & Conditions (“Terms”) govern your access to and use of the KITEFIT website, services, products, content, and any related mobile applications (collectively, the “Services”), operated by KITEFIT (“we,” “us,” or “our”).
1.2. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the Services.

2. DEFINITIONS
2.1. “User,” “you,” or “your” refers to any individual or entity accessing or using the Services.
2.2. “Content” means all text, images, graphics, video, audio, software, and other materials made available through the Services.
2.3. “Products” means any physical goods or digital items offered for sale through the Services.
2.4. “Bookings” means reservations made for lessons, camps, or experiences offered by KITEFIT.

3. ELIGIBILITY
3.1. You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement.
3.2. If you are accessing the Services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

4. USE OF THE SERVICES
4.1. You agree to use the Services in compliance with all applicable laws and regulations, and solely for lawful purposes.
4.2. You shall not:

Copy, reproduce, modify, or distribute Content except as expressly permitted;
Attempt to gain unauthorized access to any portion of the Services;
Interfere with or disrupt the integrity or performance of the Services;
Use any robot, spider, or automated means to access the Services.

5. BOOKINGS, PAYMENT & CANCELLATION
5.1. Bookings must be made through our online reservation system or by contacting us directly. Availability is subject to capacity and confirmation.
5.2. Payment is due in full at the time of booking unless otherwise agreed in writing. We accept major credit cards and other methods as displayed on our website.
5.3. Cancellation & Refunds:

You may cancel up to 14 days before the start date for a full refund.
Cancellations made less than 14 days but more than 7 days before the start date incur a 50% cancellation fee.
Cancellations within 7 days of the start date, no-shows, or early departures are non-refundable.
We reserve the right to cancel or reschedule any booking due to weather, safety concerns, or other force majeure events, in which case you will be offered a full refund or rescheduling option.

6. INTELLECTUAL PROPERTY
6.1. All Content, trademarks, logos, and service marks displayed through the Services are the property of KITEFIT or their respective owners.
6.2. Nothing in these Terms grants you any right, title, or interest in any Content, except as expressly provided herein.

7. USER CONTENT
7.1. You may submit reviews, comments, and other content (“User Content”) in connection with your use of the Services.
7.2. By submitting User Content, you grant KITEFIT a perpetual, irrevocable, royalty-free, worldwide license to use, copy, modify, publish, and distribute such User Content in any media.

8. DISCLAIMERS
8.1. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND.
8.2. KITEFIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.3. WITHOUT LIMITING THE FOREGOING, KITEFIT MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. LIMITATION OF LIABILITY
9.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KITEFIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
9.2. IN NO EVENT SHALL KITEFIT’S AGGREGATE LIABILITY EXCEED THE AMOUNTS YOU PAID TO KITEFIT IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless KITEFIT and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your breach of these Terms; (b) your use of the Services; or (c) your User Content.

11. FORCE MAJEURE
KITEFIT shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, acts of government, labor disputes, or technical failures.

12. MODIFICATIONS
12.1. We may modify these Terms at any time by posting the updated version on our website with a revised Effective Date.
12.2. Your continued use of the Services after the Effective Date constitutes your acceptance of the modified Terms.

13. GOVERNING LAW & DISPUTE RESOLUTION
13.1. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KITEFIT is headquartered, without regard to conflict-of-law provisions.
